Information about Disclosures, dates and Deadlines

Below you will find a variety of videos about the dates and deadlines that you will likely see on your contract as well as disclosures that you will encounter. These videos are meant to explain the dates and to answer any basic questions, however these videos are not all inclusive and you may have additional questions that we encourage you to ask.

Affiliated Business Disclosure

The Affiliated Business disclosure is to disclose that RE/MAX Alliance had affiliated businesses that you may or may not use.

Fort Collins Disclosures

​There are few disclosures that are specific to Fort Collins; the Fort Collins Occupancy Disclosure and the Fort Collins Radon Disclosure.

Lead based Paint Disclosure

The Lead Based Paint disclosure is meant to inform people that houses built before 1978 MIGHT have lead based paint.

Source of water

The source of water is meant to provide the buyer with the information about where the water come from for the house. This information is also provided on the seller's property disclosure.

Square footage

The square footage disclosure provides the square footage of the house and where that measurement came from.

Seller's Property Disclosure

The Seller's Property Disclosure is a document where the seller fill out anything that they know about the property. This should not be seen as a substitute for an inspection.
 

Dates and Deadlines

Alternative Earnest Money

Your earnest money check needs to be delivered to the listing agent on or before this date.
 

Loan Application

You have until this date to submit your loan application to the lender and this is the date that the lender uses to start the clock for the loan process.
 

Seller's Property Disclosure

While the buyer doesn't have to do anything for this particular deadline we do recommend that as a buyer you take a through look at the document so you exactly what the sellers are disclosing about the home.
 

Record Title

We will receive title work, review it and forward it to you.
 

Off Record Title

Any items not of public record need to be delivered by the seller to us by this date.
 

Property Insurance Termination

This is the date which the buyer has the option to terminate the contract if there are issues with getting property insurance for the home.
 

Association (HOA) Documents

They will deliver the HOA documents to us by this date.
 

Record Title Objection

If we find any issues with the title work, we need to object in writing by this date.
 

Off Record Objection

Any issues with the off-record items need to be objected to in writing.
 

HOA Termination 

The buyer has the option to terminate the contract due to issues with the HOA documents. 
 

Inspection Objection

All of your inspections need to be done by this date.  I will be forwarding you information on inspectors we would recommend so you can get in touch and schedule that directly.  You will want to be there with the inspector during the inspection if possible.  This is not typically something we attend.
 

Inspection Resolution

If there was an objection, all issues must be resolved in writing, via an Inspection Resolution.
 

Inspection Termination

If there are unsatisfactory physical conditions that would prevent you from purchasing the home, the contract will be terminated in writing by this date
 

​New ILC (Improvement Location Certificate) or Survey 

If an ILC/Survey was required or wanted, there is a date that it has to be completed by. Any issues with the ILC/Survey need to be objected to in writing and then the resolution has to be agreed upon by the resolution date.
 

​Title Resolution 

Any problems with the title work need to be resolved by this date.

​Appraisal

Appraisal must be complete by this date.  Normally the lender will order the appraisal on your behalf.

 

Appraisal Objection And Resolution

Any issues with the appraisal, such as value or conditions, must be objected to in writing. Then, all issues must be resolved in writing, via an Inspection Resolution.
 

Loan Termination

The loan termination deadline is a very important buyer deadline. It is the last day that you can termination the contract because of your loan.
